Fee Agreement

This term used in the UK is also known as the Conditional Fee Agreement.  It is the name of a legal agreement that works with the no win no fee policy. This contract is made between a law firm and its client and is used for personal claims in both the commercial and personal injury field.  With this type of case, the lawyer, or solicitor, will agree to take the claimant’s case with the knowledge that if the case is lost, this client will not have to pay the legal fees. 

If the personal injury case is won, this solicitor will not only get his fees paid but also an additional fee that is called the success fee.  This success fee will vary but the law says that it cannot be more than the amount of the legal fee.  If the case is won, it will be the losing party who will pay the fees and the court will make the decision at to what the cost of the damages will be.   

Typically, this agreement, the no win no fee agreement, the person who files the claim for a personal injury, will receive one hundred percent of his compensation and pay no lawyer fees.  There is a special insurance that can be purchased that will protect this person from additional costs that can arise during the case.
